The New York Court of Appeals ruled that when a contractor has promised to pay its workers the prevailing wages required by the U.S. Housing Act, the workers may sue under state law to enforce the promise. (Cox v. Nap Construction Company, Inc.; Araujo v. Tiano's Construction Corp., 2008 WL 2276160, June 5, 2008; for background, see Current Developments, Vol. 35, No. CD-12, p. 381.) In these companion cases, plaintiffs are workers for contractors that had agreements with the New York City Housing Authority (NYCHA) for construction work on federally funded public housing projects.
