Department Revises Rules On Hearing Procedures

HUD has revised its regulations on hearing procedures, including proceedings conducted by hearing officers that don't raise Administrative Procedure Act (APA) issues and hearings conducted by administrative law judges (ALJs) that are subject to the APA. The regulations were published in the December 17 Federal Register, effective January 16, and make no changes in proposed rules published on September 8. (For background, see Current Developments, Vol. 36, No. CD-18, p. 566.) The rules for non-APA hearings revise the discovery and deposition procedures, allow for written interrogatories, and modify the procedures for the review of hearing officers' determinations. For hearings subject to the APA, HUD has revised the discovery, appeal, and judicial review procedures, bringing the discovery procedures in line with those for non-APA hearings.
