The Federal Housing Finance Agency (FHFA) has issued proposed regulations that would generally prohibit Fannie Mae, Freddie Mac, and the Federal Home Loan Banks from investing in mortgages on properties with private transfer fee covenants. The proposed rules were published in the February 8 Federal Register, and comments are due April 11. The FHFA announced its intention to impose restrictions on involvement by Fannie Mae, Freddie Mac, and the FHLBanks in such mortgages in proposed guidance published in the August 16, 2010, Federal Register.
