In L & F Homes and Development, L.L.C. v. City of Gulfport, Miss., 2013 WL 4017711 (5th Cir. 2013), the Fifth Circuit denied various claims under federal constitutional law asserting that the failure of the City of Gulfport, Mississippi to provide water service to a predominantly white housing project was premised on the fact that it neighbored a predominantly black housing project for which service was similarly denied, thereby imposing collateral illegal racial discrimination upon the predominantly white project L & F Homes and Development, LLC ("L & F") constructed neighboring projects: Roundhill, which had a majority white population, and the neighboring "781 townhouse project, with a majority black population. Both projects were located on the same Landon Road water line.
