In 135 Wells Avenue, LLC v. Housing Appeals Committee (Not Reported in N.E.3d), 2016 WL 4382589, No. PS 000034(RBF) (Mass. Land Ct. Aug. 16, 2006), the Massachusetts Land Court decided that the Aldermen for the City of Newton, Massachusetts lacked the authority to waive deed restrictions on property conveyed to it by a private party and zoned for manufacturing, so as to allow an affordable housing project, under the statutory permit granting authority.
