The U.S. District Court for the Middle District of Tennessee dismissed an action claiming violation of an African American assisted living developer's procedural due process rights, where the developer asserted that a municipality terminated a contract with the developer to provide tax exempt bonds to purchase and improve the property, where the developer asserted that the termination was based on racial discrimination. The developer failed to submit evidence of such discrimination, and it could have opted to bring a state court action for breach of contract instead of seeking constitutional redress.
