WSHFC RELEASES REPORT ON NONPROFIT TRANSFER DISPUTES IN THE LIHTC PROGRAM

The Washington State Housing Finance Commission (WSHFC) has released "Nonprofit Transfer Disputes in the Low Income Housing Tax Credit Program: An Emerging Threat to Affordable Housing." Built into the Low-Income Housing Tax Credit (LIHTC) program is a right of first refusal (ROFR) that allows nonprofit partners, at the outset of a project, to secure rights to obtain ownership at a minimum purchase price after 15 years, once investors have claimed all tax credits and before the program's rent restrictions expire.
