The Supreme Court of Alaska ruled in Alaska Spine Center, LLC v. Mat-Su Valley Medical Center, LLC, - P.3d -, 2019 WL 1416034, Supreme Court No. S-16917 (Alaska Mar. 29, 2019) that a surgical care facility in Anchorage which sought to relocate to Wasilla, 44 miles away, and which sought a statutory exemption to the requirement that it apply for a "certificate of need" from the state in order to do so, which exemption was based on Anchorage and Wasilla being within the "same community" for purposes of the exemption, was unable to secure the exemption because the two cities did not meet the criteria for being the "same community."
