Past Illegal Storage Constitutes Ongoing RCRA Violation

The U.S. District Court for the Northern District of Ohio, Eastern Division has ruled that, when a facility had never obtained a hazardous waste storage permit from the state, the past, illegal storage of hazardous wastes still counts as an ongoing violation of RCRA. The March 20, 2006 decision was handed down in Hodgins vs. Carlisle Engineered Products, Inc. (Docket Number: 02-CV-01454).
