As a coalition of maritime industry trade associations gears up to challenge the legality of the European Directive on ship-source pollution at the High Court in London, the Bulletin takes a deeper look at the contentious Directive and the opposition to it. A coalition of maritime representative organisations is concerned that strict penalties for ship-source pollution will put existing and potential recruits off a career at sea and that it will have a counter-productive effect on the roles of classification societies and salvors, among others. As a result, they argue that the Directive 2005/35/EC of the European Parliament and of the Council on ship-source pollution and on the introduction of penalties for infringements and the accompanying Council Framework Decision 2005/667/JHA will have an ultimately detrimental effect on the environment.
