Environmental groups challenging former President Trump's changes to National Environmental Policy Act rules will soon get their day in court. During the April 21 hearing, announced yesterday by Judge James Jones of the U.S. District Court for the Western District of Virginia, the Biden administration will also offer a first glimpse at its legal position on Trump's NEPA overhaul. The virtual proceedings will center on the green groups' Nov. 19 motion for summary judgment, which asked the court to immediately scrap Trump's changes and reinstate the prior NEPA rules. Jones will also consider cross-motions from industry groups and the Trump administration that sought to preserve the NEPA overhaul. The Biden administration had previously asked the court to pause the litigation over the NEPA changes while it considered its next steps (E&E News PM, Feb. 18).
