The use of drift nets is indeed prohibited, confirmed the EU Court of Justice with its ruling of 5 March (Case C-556/07). The court dismissed the proceedings brought by France for annulment of Council Regulation 809/2007, which bans the use of such equipment, including the French 'thonaille' or tuna gillnet.rnIn 2007, France introduced two cases simultaneously, submitting an urgent application for suspension of the 2007 regulation and a separate application for annulment of Regulation 809/2007, which bans fishing vessels from keeping on board or fishing with one or more drifting gillnets. The application for an urgent ruling was rejected by the court, on 28 February 2008. The second application was rejected on 5 March.
