Copyright the Non-Reaping Sickle! Why Doesn't the Copyright Account of Profits Remedy Reap the Architect His Profit

This article examines why account of profits is not the remedy of choice in architects 'plan decisions. It argues that industry factors, the role of the architect, the free use of concepts and ideas in the industry mean that copyright does not reap the architect his profit. Ultimately account of profits is being used as restitutionary damages in the project home market, and the article argues that the remedy of account of profits in its restitutionary meaning should be a remedy for unique buildings.
