The international community, through constant and painstaking efforts, brought into effect the Doha Declaration on TRIPS and Public Health, clearing the roadblocks raised by the TRIPS Agreement, and paving the way for an effective access to medicines for the people of developing countries and least developed countries (LDCs). The seizure of drugs in transit by the EU Member States necessitates the examination of whether the Doha Declaration was indeed successful in bringing a pro-access to medicines outlook to the TRIPS Agreement. This article thus intends to examine how the Doha Declaration on TRIPS and Public Health is being sabotaged by the intellectual property maximalist agenda of the EU, and assesses the effectiveness of the Doha Declaration in facilitating access to medicines.
