A recent settlement agreement with a Delaware refinery has accelerated the installation of modern water intake technology that will reduce the impacts on fish and other aquatic life in the Delaware River. The settlement agreement, which resolves numerous alleged water-related violations, requires the refinery to: 1. Install modified traveling screens on the cooling water intake. The EPA considers these screens to be the best technology available to deal with the problem of fish impingement against the screens; 2. Conduct studies, concurrent with the screen installation, to evaluate site-specific studies to minimize entrainment of aquatic life in the cooling water system; and 3. Begin the design and permitting of an improved fish return system to ensure fish are returned to the Delaware River in a manner that does not result in reimpingement.
