Hours before the EPA put almost all ofits 14,000 workers on furlough becauseof the government shutdown, the Agencyannounced its latest measure to preservecoal-fired power in the United States.Specifically, the Agency is proposingto revise the Obama administration’s2016 Supplemental Finding that it isappropriate and necessary to regulatecoal- and oil-fired electric generatingunits (fossil EGUs) under Section 112 ofthe Clean Air Act (CAA). According tothe Agency, the methods the EPA usedin the 2016 appropriate and necessaryfinding to calculate the economic benefitsof regulating these facilities under Section112 were flawed, and therefore, it is notappropriate and necessary to take suchaction, at least under Section 112.
