Judge Garland's Environmental Decisions

On the basis of these decisions, it seems safe to say that Judge Garland is not receptive to challenges to a regulatory agency's determinations brought by the entities subject to that regulation. Put more simply, in every case examined of "Industrial Association v. EPA" he sides with EPA. Judge Garland is less deferential with regard to challenges to an agency's determinations brought by environmental advocates. He willingly grants agencies authority to regulate, but where it is evident that the agency did not fulfill its responsibilities in reaching its determinations, Judge Garland is not so deferential.
