The cases I have chosen to illustrate these topics share, in broad terms, a common theme, namely how the Courts are approaching cases where the objective is to strike a balance when some sort of environmental interest is involved. Many, although by no means all of the cases, are concerned with the familiar 'green' versus growth' battleground.
