A federal judge last week dismissed class action lawsuits filed against three companies that sell infant formula packaged in metal cans lined with the food contact and packaging material bisphenol A (BPA), ruling that the consumer fraud claims were preempted by federal regulations imposed by the Food and Drug Administration (FDA).rnBut the judge refused to close the door on similar suits against manufacturers of baby bottles, sippy cups and sport bottles containing BPA, handing plaintiffs a partial victory in a growing legal battle over the controversial chemical.
