Oil Pollution Prevention/Definition of Navigable WatersrnNotice announces a correction to a Nov. 26, 2008, final rule (73 FR 71941) that amended oil pollution prevention regulations under 40 CFR 112.2 to revise the definition of "navigable waters" in the spill prevention, control, and countermeasure requirements published on July 17, 2002. The rule restores the regulatory definition of "navigable waters" promulgated by EPA in 1973 in response to a court decision in American Petroleum Institute v. Johnson that vacated the July 2002 rulemaking. The current action revises the preamble to the final rule to correct references to the citation for the court case.
