EPA Revises Rule on 'Buy American' Waiver For Water Infrastructure Stimulus Projects

The Environmental Protection Agency has revised the conditions under which it will grant a waiver of the "Buy American" provision of the American Recovery and Reinvestment Act for water infrastructure projects, the agency said in an Aug. 10 Federal Register notice (74 Fed. Reg. 39,959).rnThe waiver applies to incidental "de minimis" components of the clean water and drinking water infrastructure projects funded by ARRA (Pub. L. No. 111-5). EPA had determined that imposing ARRA's Buy American requirements for this category "is not in the public interest."
