A New Jersey couple asked the U.S. Supreme Court Sept. 16 to overturn a state fine and restoration order related to wetlands filling on their property, contending that a warrantless search of their property was illegal (Huber v. New Jersey Department of Environmental Protection, U.S., No. 10-388, 9/16/10).rnA state inspector conducted a warrantless search of Michelle and Robert Huber's backyard in Hunterdon County, N.J., on July 3, 2002. Such searches are authorized by the New Jersey Freshwater Wetlands Protection Act and the state Conservation and Development Act.
