EPA Court Filing Cites 'Exaggerated' Claims By Critics of Cross-State Air Pollution Rule

The Environmental Protection Agency said in a court filing that critics of the Cross-State Air Pollution Rule have "grossly exaggerated" claims that the regulation will require drastic emissions reductions on Jan. 1, 2012 (EME Homer City Generation LP v. EPA, D.C. Cir., No. 11-1302, opposition brief filed 12/1/11). State emissions budgets for 2012 and 2013 are based on emissions controls that already exist or that have been planned, EPA said Dec. 1 in opposing several petitioners' motions to stay the rule in the U.S. Court of Appeals for the D.C. Circuit.
