Environmentalists Seek Injunction to Block West Virginia Mine Over Selenium Discharges

Operations at an ICG Eastern surface mine in West Virginia should be enjoined until ongoing unlawful selenium discharges stop, three environmental groups said in a federal lawsuit filed March 23 (Sierra Club v. ICG Eastern LLC, S.D. W.Va., No. 2:201 lcv00023, 3/23/11). The lawsuit—brought by the Sierra Club, the Ohio Valley Environmental Coalition and the West Virginia Highlands Conservancy—charges the coal company with persistent violations of the Clean Water Act and the Surface Mining Control and Reclamation Act, as well as the conditions of its National Pollutant Discharge Elimination System permit issued by West Virginia.
