An appeals court panel suggested during oral arguments Oct. 12 that it may dismiss a case related to federal approval of California emissions standards due to lack of jurisdiction (American Road & Transportation Builders Ass'n v. EPA, D.C. Cir., No. 11-1256, 10/12/12). "It appears [the Environmental Protection Agency] has not made.the determination necessary for us to have jurisdiction," Judge Judith Rogers of the U.S. Court of Appeals for the District of Columbia Circuit said near the end of oral arguments.
