EAB Denies Peabody Petition for Review Over Operating Permit for Arizona Coal Mine

The Environmental Protection Agency's Environmental Appeals Board denied Peabody Western Coal Co.'s petition for review of its operating permit from the Navajo Nation for a coal mine in Arizona (In re: Peabody Western Coal Co., EPA EAB, CAA Appeal No. 11-01,3/13/12). The Navajo Nation Environmental Protection Agency issued the Clean Air Act Title V permit under delegated authority from EPA under 40 C.F.R. Part 71.
