OMB Begins Review of EPA Guidance Clarifying Clean Water Act Jurisdiction

The White House has begun reviewing a joint guidance by the Environmental Protection Agency and U.S. Army Corps of Engineers that clarifies the scope of Clean Water Act jurisdiction over wetlands, rivers, streams, and lakes. In a Feb. 22 e-mail, EPA confirmed that both agencies submitted "final guidance" a day earlier to clarify protection of waters under the Clean Water Act to OMB for interagency review. The joint guidance, which was proposed in May, clarified which waters are subject to Clean Water Act jurisdiction. The proposal drew opposition from farmers, builders, and industry groups and support from environmental groups (42 ER 998, 5/6/11).
