The White House Office of Management and Budget has begun reviewing a final rule that would prevent fish kills during cooling water intakes and a proposed rule to require electronic filing of various data under the National Pollutant Discharge Elimination System program. EPA sent the final rule for cooling water intake structures to OMB for interagency review Jan. 25 and submitted the proposed NPDES electronic filing rule Jan. 20, according to OMB's website. The review typically is the last step for a rule before it is released. In March, EPA proposed a rule to require facilities to obtain NPDES permits that reflect the best available technology in the design, location, and construction of cooling water intake towers to minimize impingement (trapping of fish against intake screens) and entrainment (drawing of fish into the cooling water system). The rule was proposed under Section 316 (b) of the Clean Water Act.
