Municipalities May Not Impose Waste Fees On Recycling Efforts, Attorney General Says

Tennessee counties and municipalities may not impose solid waste management fees on materials received by their facilities for recycling, according to the state attorney general. Attorney General Robert E. Cooper Jr. (D) said in an Oct. 22 opinion (No. 13-81) that recovered materials actually are materials removed from the waste stream, so they aren't covered by solid waste management fees authorized under state law. Local governments also may not impose solid waste management fees on the shredding of untreated and unpainted wood into mulch or other useful products, he said in the opinion.
