Supreme Court Won't Hear Air Act Case Challenging EPA Disapproval of Texas SIP

The U.S. Supreme Court on Oct. 7 denied a request to review a Clean Air Act case that upheld the Environmental Protection Agency's disapproval of an affirmative defense in a Texas state implementation plan that would have provided a defense to civil penalties for excess emissions occurring during planned startup, shutdown and maintenance activities (Lumi-nant Generation Co. v. EPA, U.S., No. 12-1484, cert, denied 10/7/13).
