A federal appeals court has dismissed a mining company's request to declare that a state agency had authority over its permits and enjoin an Interior Department enforcement action alleging the company did not adequately reclaim two mining sites in Oklahoma, saying the mine operator has to first await a decision in its administrative hearings (Farrell-Cooper Mining Co. v. U.S. Dep't of the Interior, 2013 BL 236419, 10th Cir., Nos. 12-7045 & 12-7048, 9/5/13).
