Law Lets State's Environmental Regulators Attach Liens to Properties for Cleanup Costs

A bill (H.B. 95) enacted at the end of Delaware's 2013 legislative session authorizes state environmental regulators to attach a lien to a property to recover taxpayer funds spent on investigating and cleaning up contamination at the site. The legislation brings the state in line with the federal government and at least 34 states, including all of Delaware's neighbors, which have statutory authority to impose environmental liens.
