Court Upholds Dallas Ordinance Providing Incentives to Compressed Natural Gas Cabs

A federal appeals court upheld a Dallas ordinance that was designed to curb ozone pollution by allowing taxicabs powered by compressed natural gas to cut ahead of gasoline-powered cabs when picking up passengers at a municipal airport (Ass'n of Taxi-cab Operators USA v. Dallas, 5th Cir., No. 12-10470, 6/13/13). The U.S. Court of Appeals for the Fifth Circuit June 13 found the Clean Air Act does not preempt the local ordinance and affirmed the U.S. District Court for the Northern District of Texas's summary judgment for Dallas.
