Companies Sue EPA Over Final Rule Adjusting Allowance System for HCFCs for 2012-2014

Chemical companies are suing the Environmental Protection Agency over a final rule that adjusted its system for setting consumption and production allowances and baselines for two hydrochlorofluorocar-bons in 2012-2014 (Arkema Inc. v. EPA, D.C. Cir., No. 13-1193,5/31/13). Arkema Inc., Solvay Fluorides LLC, and Solvay Specialty Polymers USA LLC filed a petition for review May 31 in the U.S. Court of Appeals for the District of Columbia Circuit over the April 3 final rule, which establishes company-by-company baselines and allowances for HCFC-22 and HCFC-142b (78 Fed. Reg. 20,004; 44 ER 977, 4/5/13).
