The Environmental Protection Agency is reviewing its policy of exempting increases in hazardous air pollutant emissions during equipment startup, shutdown, and malfunction at refineries, chemical plants, and other industrial facilities, Wendy Blake, EPA's assistant general counsel, said April 11. The review of the exemption policy is occurring as the agency conducts risk and technology reviews of air toxic standards that EPA has already established under the national emissions standards for hazardous air pollutants (NESHAP) program, Blake told participants at a Clean Air Act seminar co-sponsored by the American Law Institute and Environmental Law Institute and hosted by Arnold & Porter LLC.
