EPA Waste Rule Altered During OMB Review After Industry Meetings, Documents Show

An Environmental Protection Agency final rule governing solid wastes burned as fuel was altered in a way that is likely to broaden the types of materials eligible for a less stringent category of regulation after industry officials met with EPA and the White House to press for the change, newly released documents show. EPA released a document Feb. 7 showing that the version of the final rule that cleared White House review in December 2012 listed an additional category of materials-recycling residuals-that would be "good candidates" to be listed as fuels, rather than solid wastes, in a subsequent rulemaking.
