Royal Dutch Shell Plc cannot be allowed to preemptively head off challenges to oil spill response plans through a lawsuit of its own seeking a declaratory judgment approving the response plans, an appeals court ruled Nov. 12 (Shell Gulf of Mexico Inc. v.
