Proposed Water Rule Illegally Broad, Governors, State AGs Say in Comments

Governors and attorneys general representing 14 states have requested that the proposed waters of the U.S. rule be withdrawn as it "impermissibly seeks to broaden federal authority." In a comment letter dated Oct. 8, the state officials said "numerous features" in the proposed rule, proposed jointly by the Environmental Protection Agency and U.S. Army Corps of Engineers, were illegal. The proposal greatly expands the definition of waters that would fall under federal jurisdiction and would unduly burden farmers, landowners and developers, the governors and attorneys general said. The letter was signed by the governors of Iowa, Kansas, Mississippi, Nebraska, North Carolina and South Carolina and the attorneys general of Alabama, Alaska, Georgia, Kansas, Louisiana, Nebraska, North Dakota, Oklahoma, South Carolina, South Dakota and West Virginia. All the signatories are Republican.
