A federal rule that seeks to clarify the scope of Clean Water Act jurisdiction will be challenged once it becomes final because it's inconsistent with U.S. Supreme Court rulings, attorneys predicted during a July 1 webinar on the proposed rule. "There is no doubt this rule will be challenged. The big question is which court will take it up first," Kathryn Kusske Floyd, an attorney in the Washington D.C. office of Venable LLP, said of the rule proposed jointly by the Environmental Protection Agency and the U.S. Army Corps of Engineers April 21 (79 Fed. Reg. 22,188; 45 ER 1257, 4/25/14).
