The National Association of Home Builders and allies, fighting a pair of negotiated settlements that established a schedule for Endangered Species Act decisions on the status of 251 species, have appealed a decision that upheld the settlements (Nat'l Ass'n of Home Builders v. U.S. Fish & Wildlife Serv., D.C. Cir., No. 14-5121, 5/22/14). The NAHB, two other groups of builders and a Texas property owners group filed their appeal at the U.S. Court of Appeals for the District of Columbia Circuit May 22 after losing their case in the U.S. District Court for the District of Columbia.
