The Environmental Protection Agency should recognize the primacy of states to establish achievable emissions standards for existing power plants when it proposes carbon dioxide standards in June, Oklahoma Attorney General Scott Pruitt said. States should have the authority to set less stringent carbon dioxide emissions standards than mandated by the EPA in order to ensure cost-effective and reliable electricity generation, as provided by the Clean Air Act, Pruitt said during a May 20 forum sponsored by the Federalist Society. Section 111 (d) of the Clean Air Act gives states significant authority to determine how best to implement the carbon dioxide emissions guidelines the EPA will propose for existing power plant.
