Court Denies Reconsideration Motion In Dredge-and-Fill Permit Takings Case

The U.S. Court of Federal Claims denied motions by two municipal solid waste management companies to reconsider its dismissal, due to lack of subject matter jurisdiction, of their takings claim related to a denied dredge-and-fill permit (Res. Invs., Inc. v. United States.2014 BL 94658, Fed. Cl., No. 98-00419, 4/3/14). Judge Lawrence F. Block of the U.S. Court of Federal Claims, in an April 3 opinion and order, found that Resource Investments, Inc. and Land Recovery, Inc. failed to meet the high threshold for prevailing on a motion for reconsideration.
