Attorneys General off 21 States Urge Third Circuit to Invalidate Bay TMDL

The attorneys general of 21 states filed a joint am-icus brief urging the U.S. Court of Appeals for the Third Circuit to invalidate the Environmental Protection Agency's mandatory restoration program for the Chesapeake Bay (Am. Farm Bureau Fed'n v. EPA, 3d Cir., No. 13-04079, amicus brief filed 2/3/14). The amicus brief supports the American Farm Bureau Federation's appeal of the U.S. District Court for the Middle District of Pennsylvania's 2013 ruling that found the EPA has authority under the Clean Water Act to impose a total maximum daily load and restoration program on the six states that share the Chesapeake Bay Watershed (44 ER 2801, 9/20/13). The TMDL applies to Delaware, Maryland, New York, Pennsylvania, Virginia, West Virginia and the District of Columbia.
