Environmental groups are entitled to writ of mandamus requiring Environmental Protection Agency to respond to petition groups filed to ban chlorpyrifos pesticide under Federal Food, Drug, and Cosmetic Act and Federal Insecticide, Fungicide, and Rodenticide Act, because: (1) EPA has delayed issuing response for eight years and does not provide concrete timeline for resolving petition; (2) even though EPA initially found chlorpyrifos safe, EPA reported it now considers chlorpyrifos significant threat to water supplies and is considering nationwide ban; and (3) EPA has significant history of missing deadlines it set for itself in these proceedings.
