Colorado Gov. John Hickenlooper (D) is weighing alternatives now that the state Supreme Court has declined to consider his petition challenging Colorado Attorney General Cynthia Coffman's (R) decision to sue the Environmental Protection Agency over its Clean Power Plan (Hickenlooper v. Coffman, Colo., No. 2015SA296, 12/3/15), The Colorado Supreme Court ruled Dec. 3 because there is an "adequate alternative remedy" available to Hickenlooper; the governor's petition for rule to show cause is denied. Hickenlooper filed a petition in November asking the state high court to rule that he, not Coffman, has the ultimate authority to decide when the state will or will not sue the federal government in federal court.
