The Environmental Protection Agency on Dec. 1 published its final updated national emission standards for hazardous air pollutants for petroleum refineries, opening a 60-day period for legal challenges to the rule (80 Fed Reg. 75,178). The revised standards, signed Sept. 29, include a new requirement that refineries install monitors to measure fence-line concentrations of benzene by Feb. 1, 2018. The rule (RIN 2060-AQ75) also established new emissions standards for delayed cokers and requirements that refineries improve the operating efficiency of flaring operations. Any litigation challenging the revised standards must be filed with the U.S. Court of Appeals for the District of Columbia Circuit, which has exclusive jurisdiction over nationally applicable rules issued under the Clean Air Act.
