Wood-Based Material May Be Regulated As Fuel When Burned, EPA Says

A wood-based alternative fuel may be regulated as a fuel rather than as a solid waste and is therefore subject to less stringent Clean Air Act standards when burned, according to the Environmental Protection Agency. Evergreen Fuel, manufactured by Evergreen Recycling Solutions LLC, of Newark, N.J., is a nonwaste fuel product under 40 CFR 241.3(b)(4), the EPA said in a comfort letter date Nov. 12. The letter provides regulatory clarity under the agency's 2012 nonhazardous secondary materials rule.
