Love Canal Residents May Pursue Claims Against Niagara Falls, Several Companies

A group of residents may pursue personal injury and property damage claims against the City of Niagara Falls, N.Y., and several companies for their alleged failure to clean up contamination at the Love Canal Superfund site, a New York appeals court has ruled (Abbo-Bradley v. City of Niagara Falls, 2015 BL 324590, N.Y. App. Div., 4th Dept., No. 1067 CA 14-02111, 10/2/15). The claims may proceed because the plaintiffs aren't challenging a Superfund remedy, but are challenging the defendants' execution of the cleanup, the New York Supreme Court, Appellate Division, said in the Oct. 2 decision.
