Colorado Supreme Court to Review Challenges to Municipal Fracking Bans

The Colorado Supreme Court has agreed to hear legal challenges to two municipal bans on hydraulic fracturing (Food & Water Watch v. Top Operating Co., Colo., No. 15SC667, petition for writ of certiorari filed 9/21/15; Fort Collins v. Colo. Oil & Gas Ass'n, Colo., No. 15SC668, petition for writ of certiorari filed 9/21/15). The state high court, ruling Sept. 21 on a petition for writ of certiorari, agreed to take up the question of whether home-rule cities are preempted from passing local land-use prohibitions on the use of hydraulic fracturing in oil and gas operations and the storage of related waste products within city limits when the Colorado Oil and Gas Conservation Commission regulates hydraulic fracturing within the state.
