Shareholder Lawsuit Against Duke Energy Over Coal Ash Spills Delayed Until Nov. 15

A lawsuit filed against Duke Energy directors by company shareholders over coal ash releases was put on hold until Nov. 15 (In re Duke Energy Corp. Coal Ash Derivative Litigation, Del. Ch., No. 9682-VCN, 8/31/15). Citing pending enforcement actions and litigation in other state and federal courts over similar allegations of lack of maintenance and oversight of coal ash storage sites, the Delaware Chancery Court granted a request Aug. 31 by the utility to temporarily delay pending derivative litigation.
